These terms govern your use of HeritageX (the “Service”), operated from Australia. By using the Service you agree to these terms. If you do not agree, please do not use the Service.

1. What HeritageX is

HeritageX is an independent information service for the Australian collectible number-plate and classic-car market. It compiles publicly available auction results into searchable data, market reports and indicative valuations, and it facilitates private introductions between buyers and sellers by sealed offer. HeritageX is an information and introduction service only.

2. Information only — not advice

All data, market reports, comparable sales and valuations are provided for general information only. Valuations are indicative estimates derived from comparable sold results and are not appraisals, guarantees of value, or financial, investment, tax or legal advice. You are responsible for your own decisions and should obtain independent professional advice where appropriate.

3. Independence and no affiliation

HeritageX is not affiliated with, sponsored by, or endorsed by any auction house, registry or road authority. Third-party names, marks and listings referred to on the Service belong to their respective owners and are used for identification and reference only.

4. Data sources and accuracy

Information is compiled from publicly available auction results and other public sources. While we take care to compile it accurately, the Service is provided “as is” and “as available”, and we make no warranty that any data is accurate, complete, current or fit for a particular purpose. Prices and availability change, and records may be incomplete or out of date.

5. Sealed offers and introductions

Where the Service facilitates a sealed sale, HeritageX provides introductions and guidance only. It is not a party to any sale, does not hold funds, and does not complete registration transfers — a registration transfers through the relevant state road authority (for example Service NSW, VicRoads and equivalents). Offers and reserves are handled privately and are not published. Any transaction is solely between the buyer and seller.

6. Acceptable use

You agree not to use the Service unlawfully; not to scrape, harvest, copy or systematically extract its data or resell or redistribute it; not to attempt to gain unauthorised access, disrupt or overload the Service; and not to misrepresent your identity. We may suspend or terminate access that breaches these terms.

7. Intellectual property

The Service — including its compilation and arrangement of data, its reports, text, design and branding — is owned by HeritageX or its licensors and is protected by law. Source listings and images remain the property of their respective owners. You may use the Service for your own personal, non-commercial reference.

8. Limitation of liability

To the maximum extent permitted by law, HeritageX is not liable for any loss or damage arising from your use of, or reliance on, the Service or its data, including any decision to buy, sell or value an item. Nothing in these terms excludes, restricts or modifies any consumer guarantee, right or remedy you may have under the Australian Consumer Law or other law that cannot lawfully be excluded.

9. Changes

We may update these terms from time to time. Material changes will be reflected by the “last updated” date above, and your continued use of the Service after a change means you accept the updated terms.

10. Governing law

These terms are governed by the laws of New South Wales, Australia, and you submit to the non-exclusive jurisdiction of the courts of that state.
